WAIAKOA WILDFLOWERS PARTICIPATION & LIABILITY WAIVER AGREEMENT

Waiakoa Wildflowers, LLC (“Farm,” “we,” or “us”)
Aloha and welcome! We’re so glad you’ll be joining us for a workshop at our farm. These gatherings are meant to be joyful, creative, and connected to the land. Because farm environments naturally come with a few risks, we ask that you read this agreement and acknowledge it before attending. By completing your booking you agree to the terms below.
Understanding the Setting and Activities
Workshops take place on a working farm located on private property. This means you might encounter conditions including but not limited to uneven ground, dirt, rocks, roots, insects, tools, farm equipment, animals, plants, and changing weather conditions. Activities may include, but are not limited to, walking, bending, kneeling, harvesting, handling plants, or natural materials, light crafting, and using simple tools (such as scissors or gardening tools).
We’ll do our best to provide a safe environment, but we can’t eliminate all risks. By booking you agree that you understand these conditions and choose to participate voluntarily.
2. Assumption of Risk
You understand and agree that participation involves certain inherent and unavoidable risks - including but not limited to minor injuries, allergic reactions, slips or falls, and other hazards. You voluntarily assume all such risks, whether known or unknown, including those that may result from ordinary negligence of the Farm, its staff, or the owner(s) of the property where activities occur.
3. Release of Liability
To the fullest extent allowed by Hawai‘i law, you waive, release, and discharge the following parties from any and all claims or liability arising from your participation:
Waiakoa Wildflowers, LLC, its members, employees, contractors, and volunteers; and
The owner(s) of the property on which the activities occur.
This includes claims of ordinary negligence, but not for gross negligence or willful misconduct, which cannot be waived.
4. Indemnification
You agree to defend, indemnify, and hold harmless the Farm and the property owner(s) from any claims, damages, or expenses (including attorneys’ fees) resulting from your actions or from any minors or guests under your supervision.
5. Food, Allergies & Health
Workshops may include food or drink made with farm-grown or locally sourced ingredients. You are responsible for managing your own allergies or dietary restrictions and for informing the Farm of any known conditions. We cannot guarantee an allergen-free environment.
6. Photo & Media Use (Optional)
We love sharing the beauty of our workshops! Photos and videos may be taken during events for social media or promotional purposes.
If you prefer not to be photographed, please let us know by email before the event, and we will happily respect your wishes.
7. Minors
For participants under 18, a parent or guardian must complete this waiver on their behalf. Parents/guardians accept the above terms for the minor participant and agree not to bring claims to the fullest extent allowed by law.
8. Medical Care
If emergency care is needed, you authorize the Farm to obtain treatment and agree that you are responsible for any resulting costs.
9. Governing Law
This agreement is governed by the laws of the State of Hawai‘i. If any part of this agreement is found unenforceable, the remaining sections still apply.
Digital Acknowledgment
By completing your booking, checking the acknowledgment box, or otherwise registering for this event, you confirm that you have read, understood, and agreed to this Participation & Liability Waiver.
If you are signing on behalf of a minor, you certify that you are their parent or legal guardian and accept these terms on their behalf.
If you are purhasing for additional participants, agreeing to this waiver applies to all individuals you register.
